Welcome to SpeedCubeShop (“SpeedCubeShop,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile experiences, social pages we control, and any online checkout or services that link to these Terms (collectively, the “Services”). By visiting or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Eligibility & Accounts

You must be at least the age of majority in your state/province to purchase. If you permit a minor to use a device you own to access our site, you are responsible for their activity. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You’re responsible for all activity under your account and may not transfer or sell it.

Product Information, Safety & Compliance

We specialize in twisty puzzles, speed cubing accessories, and related toys/games. Colors, finishes, packaging, and minor details may vary from photos due to manufacturing runs or device display settings.

Safety: Many products may include small parts, strong magnets, springs, and lubricants—choking and ingestion hazards. Not for children under 3 years. Use under appropriate supervision. Inspect products before use; discontinue use if damaged.

We strive to comply with applicable U.S. product-safety laws and labeling requirements. For products shipped to California, certain items may display Proposition 65 warnings where applicable. Always follow manufacturer instructions.

Orders, Acceptance & Cancellations

Your order is an offer to buy; we may accept or decline any order (or portion) at our discretion, including for suspected fraud/abuse, pricing or inventory errors, purchase-limit rules, or policy violations. An order is accepted when we charge your payment method and/or send an order-confirmation email. Once processing begins, we may be unable to cancel or modify.

We may contact you for identity or payment verification. If we change or cancel an order, we’ll attempt to notify you using the email/phone/billing address provided.

Preorders & Backorders

From time to time, we offer preorders/backorders. Estimated ship windows are estimates and may change due to manufacturing, quality control, or transit delays. We may ship partial orders or hold until all items are available, as shown at checkout. You’ll be charged at order time unless otherwise stated. Cancellation of preorders/backorders is subject to our Refund & Returns Policy.

Pricing, Taxes & Promotions

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at checkout. Unless stated, prices exclude shipping/handling, taxes, customs, duties, and import fees.

Promotions/coupons: One per order unless stated, non-transferable, no cash value, subject to stated terms. We may limit items, quantities, customers, or duration. If you return promotional bundles/BOGO sets, your refund may be adjusted to reflect kept items at full price per promo terms.

Discount code exclusions: Unless expressly stated otherwise, discount codes and promotional offers do not apply to items already marked down or on clearance, bundles/BOGO sets, services (including workshops or event tickets), protection plans or warranties, gift cards, taxes, shipping/handling, or third-party fees. Discount codes may not be combined or stacked with other offers, automatic discounts, or price matching, and are limited to one per order. Additional product- or collection-level exclusions may apply as stated on the offer page.

Payment & Billing

You authorize us (and our payment processors) to charge your selected payment method for all amounts due, including taxes and shipping. You represent that you’re authorized to use the payment method and that billing info is accurate. If your payment fails or is reversed (including chargebacks), you remain responsible for the amount and any associated fees. We may use third-party tools to detect and prevent fraud.

Payment Authorization, Order Verification & Anti-Fraud Screening

You authorize us and our payment partners to verify payment information and to charge, capture, or place a temporary authorization for the amount of your order. We may use automated and manual anti-fraud screening. We may contact you to request additional information (for example: confirmation emails, billing/shipping address verification, or ID documentation). If you do not complete verification, or if we suspect fraud, abuse, or unauthorized activity (including reseller or bulk-purchase activity not permitted by these Terms), we may delay processing, limit quantities, or cancel the order.

Processing and delivery timeframes begin after payment has been verified. We are not responsible for delays caused by payment verification. If we cancel before shipment, we will reverse or refund any amounts we have captured for the canceled items in accordance with our Refund & Returns Policy. Shipping, Delivery & Risk of Loss

We ship to the address you provide. Delivery timelines are estimates only; carriers and customs may delay delivery. Title and risk of loss transfer to you when we deliver items to the carrier. Please inspect packages upon receipt and notify the carrier and us promptly of damage or loss. International customers are responsible for customs clearance and any import fees.

Returns, Exchanges & Final Sale

Returns/exchanges are governed by our Refund & Returns Policy. Certain items (e.g., limited drops, mystery boxes, consumables like lubricants once opened, gift cards, and items marked “final sale”) are not returnable except as required by law or for defects covered by our policy.

International, Export & Sanctions

You are responsible for ensuring that purchases comply with import/export laws where you reside. You may not purchase or ship products to or on behalf of persons or locations subject to U.S. embargoes/sanctions or other applicable trade restrictions.

Intellectual Property

All content in the Services—including text, graphics, images, video, audio, logos, trademarks, product names, and arrangement—is owned by SpeedCubeShop or our licensors and protected by law. You may use the Services for personal, non-commercial purposes only. No rights are granted by implication. Do not copy, modify, distribute, display, or create derivative works without our prior written consent.

User Content, Reviews & Feedback

If you post reviews, photos, videos, or submit ideas, suggestions, or other content (“Feedback”), you grant SpeedCubeShop a perpetual, worldwide, irrevocable, sublicensable, royalty-free license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works in any media for any lawful purpose. You represent you have rights to your content, that it’s accurate and lawful, and that you’ve disclosed any compensation/incentives. We may moderate or remove content at our discretion. Do not post unlawful, threatening, defamatory, obscene, or infringing content or malware.

Optional Tools & Third-Party Links

We may offer third-party tools (e.g., payment providers, shipping apps, review widgets) “as is” and “as available.” Your use is at your discretion and subject to the third party’s terms. The Services may link to third-party websites or include embedded third-party functionality; we’re not responsible for their content, policies, or actions.

Privacy

Your personal information is collected and processed as described in our Privacy Policy. Because our Services may be hosted by third parties, certain information about your access and purchases may be processed by those providers to operate and improve the platform, as described in their privacy materials. SMS/Text Messaging

By consenting to SMS, you agree to receive texts (e.g., order updates, cart reminders, marketing) to the phone number you provide. Message and data rates may apply. Message frequency varies. Text STOP to opt out; HELP for help. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase. Your phone number will be handled per our Privacy Policy.

Gift Cards, Store Credit & Loyalty

Gift cards and store credits are redeemable only at SpeedCubeShop and are not reloadable, refundable, or redeemable for cash except as required by law. Treat as cash; we are not responsible for lost or stolen cards/credits. No fees; no expiration earlier than permitted by law. Additional terms may apply to loyalty points or rewards and may change prospectively.

Events & Tickets

Event tickets, workshops, or competition entries are subject to posted event terms. Unless we cancel or materially change the event, tickets are typically non-refundable and non-transferable. We may refuse or revoke admission for safety, policy violations, or fraud and provide a refund where required.

Prohibited Uses

Do not use the Services for anything unlawful, harmful, harassing, defamatory, infringing, obscene, or abusive; to submit false or misleading information; to transmit spam/malware; to scrape or harvest data; to attempt to bypass security; or to resell products if prohibited by our purchase-limit rules. We may suspend or terminate access for violations.

DMCA & IP Complaints

If you believe content infringes your copyright, please send a notice with: (a) your contact info; (b) identification of the copyrighted work; (c) the URL/location of the material; (d) a statement under penalty of perjury that you have a good-faith belief the use is unauthorized; (e) a statement that your notice is accurate and you’re authorized to act; and (f) your physical or electronic signature. Disclaimers

Except as expressly stated by SpeedCubeShop in writing, the Services and all products are provided “as is” and “as available.” We do not warrant uninterrupted, timely, secure, or error-free operation, or that defects will be corrected. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions don’t allow certain disclaimers, so portions may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, SpeedCubeShop’s total liability for any claim arising out of or relating to the Services or products will not exceed the amount you paid to SpeedCubeShop for the product(s) at issue in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenues, savings, goodwill, or data—even if advised of the possibility. Some jurisdictions don’t allow certain limitations; portions may not apply to you.

Indemnification

You agree to indemnify and hold harmless SpeedCubeShop and its officers, directors, employees, agents, and service providers from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law, or misuse of the Services. We’ll notify you of any claim and may control the defense; you’ll cooperate as reasonably requested.

Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government actions, supply-chain disruptions, carrier failures, or internet outages.

Pre-Dispute Resolution

Most issues can be resolved quickly. Before initiating any legal claim relating to the Services or products, you agree to first contact us at service@speedcubeshop.com with a description of your dispute and your desired resolution, and to give us thirty (30) days to work with you in good faith to resolve the matter.

Class Action Waiver

If, after providing SpeedCubeShop notice of your claim and at least thirty (30) days to resolve it, you and SpeedCubeShop have still not reached a resolution, you agree to waive your right to bring or participate in a class action or other representative proceeding with respect to your claim.

Governing Law & Venue

These Terms are governed by the laws of the State of Nevada and applicable U.S. federal law, without regard to conflicts principles. Exclusive venue and jurisdiction lie in the state or federal courts located in Clark County, Nevada.

Changes to the Services or Terms

We may update these Terms by posting a new date/version on this page. Material changes will be notified as required by law and become effective on the date stated. Your continued use after the effective date constitutes acceptance.

Assignment; No Waiver; Severability; Entire Agreement

You may not assign your rights or obligations under these Terms without our prior written consent; we may assign without restriction. Our failure to enforce any provision is not a waiver. If any provision is unenforceable, it will be severed and the remainder will remain in effect. These Terms (plus policies incorporated by reference, including the Privacy Policy and Refund & Returns Policy) are the entire agreement between you and SpeedCubeShop regarding the Services and supersede prior communications.
